By using our website and/or engaging us for Services, you agree to these Terms & Conditions, as well as our Privacy Policy. If you do not agree, you must not use our website or services.

3. Services

AIIM.agency provides AI implementation services, which may include, but are not limited to, the development of custom AI models, integration of AI tools, automation of business processes, and strategic consulting. The specific scope of work, deliverables, and fees for any project will be outlined in a separate Statement of Work (SOW) or a client agreement.

4. Client Responsibilities

  • Accuracy of Information: You are responsible for the accuracy, quality, and legality of all Input you provide to us.
  • Permissions: You represent and warrant that you have all necessary rights, licenses, and permissions to provide the Input to AIIM.agency and that the Input does not infringe upon the intellectual property or other rights of any third party.
  • Misuse: You agree not to use our Services for any unlawful, harmful, or abusive activity, including but not limited to:
    • Violating any applicable laws or regulations.
    • Infringing on the intellectual property rights of others.
    • Generating or promoting discriminatory, offensive, or harmful content.

5. Intellectual Property Rights

  • Client Input: You retain all ownership rights to the Input you provide to us. You grant AIIM.agency a limited, non-exclusive, worldwide, royalty-free license to use, copy, modify, and process the Input solely for the purpose of providing the Services to you.
  • AIIM.agency Output: The ownership and use of the Output will be as specified in the specific SOW or client agreement. Unless otherwise agreed, AIIM.agency retains all Intellectual Property rights in the underlying code, models, and methodologies used to produce the Output. The Client will be granted a license to use the Output for their internal business purposes.
  • Third-Party Components: Our Services may incorporate or rely on third-party software, open-source components, or AI models. The use of such components is subject to their respective licenses and terms, and AIIM.agency is not responsible for any issues arising from their use.

6. Disclaimers and Limitation of Liability

  • Probabilistic Nature of AI: You acknowledge that AI is a rapidly evolving field and that the Output may not always be accurate, complete, or free from errors, “hallucinations,” or biases. You are responsible for evaluating the Output and its appropriateness for your intended use, including through human review and supervision, before using or sharing it.
  • “AS IS” Basis: All Services and their Output are provided on an “as is” and “as available” basis. AIIM.agency makes no warranties, express or implied, regarding the accuracy, reliability, or fitness for a particular purpose of the Services or Output.
  • Limitation of Liability: To the fullest extent permitted by law, AIIM.agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
    • Your use of or inability to use the Services.
    • Any Output obtained from the Services.
    • Any unauthorized access to or use of our servers and/or any personal information stored therein.

7. Confidentiality

AIIM.agency agrees to keep all Client Input and confidential business information confidential and will not disclose it to any third party, except as required to provide the Services or as required by law.

8. Termination

We reserve the right to suspend or terminate your access to our Services or delete your account at our sole discretion, for any reason, including but not limited to, a breach of these Terms & Conditions.

9. Governing Law
